1. Overview
These Terms of Service govern your use of the KouyateIQ platform. This is a draft requiring legal review before final production launch.
2. AI-Assisted Informational Service
KouyateIQ provides AI-assisted informational analysis. We do not guarantee contract awards, eligibility, compliance, responsiveness, or accuracy. The analysis may contain errors or omissions.
3. No Legal or Professional Advice
KouyateIQ is not a law firm, procurement authority, or substitute for legal, financial, insurance, accounting, or procurement advice. Always consult qualified professionals.
4. Customer Responsibility to Verify
You remain responsible for reviewing the complete original solicitation, amendments, attachments, official agency notices, deadlines, and procurement portal.
5. Customer Authority to Upload
You represent that you are authorized to submit any document you upload. You must not upload documents you are not authorized to share.
6. Prohibited Content
You must not upload classified information, Social Security numbers, Canadian Social Insurance Numbers, banking credentials, payment-card data, passwords, private medical records, export-controlled data, or illegally obtained material.
7. User Account Responsibilities
You are responsible for maintaining the security of your account and for all activity under your account.
8. Subscription Billing
Subscriptions are billed through Stripe. Billing periods are based on your Stripe subscription, not calendar months. Plan limits are not unlimited.
9. Usage Limits
Usage is incremented only when an analysis completes successfully. Failed analyses do not consume your allowance. Reaching your limit requires upgrading or contacting us.
10. Cancellation
You may cancel your subscription. Access continues through the end of your billing period where applicable. See our Refund and Cancellation Policy for details.
11. Intellectual Property
KouyateIQ retains rights to the platform. You retain rights to your uploaded documents and business information.
12. Third-Party Services
We use third-party services including AI providers, Stripe, and email providers. Their terms also apply.
13. Data Retention
Uploaded raw documents are retained for a default of 90 days after successful analysis. You may request earlier deletion.
14. Service Availability
We do not guarantee uninterrupted service availability. We are not liable for downtime or service interruptions.
15. Limitation of Liability
KouyateIQ is not liable for decisions made based on AI-assisted analysis. Indemnification language is included for legal review.
16. KouyateIQ Landscaping Lead Connect
KouyateIQ Landscaping Lead Connect is a matching platform that connects homeowners, property managers, businesses, and organizations with independent landscaping providers. KouyateIQ is not the landscaping contractor and does not perform landscaping work.
17. Providers Are Independent Contractors
Landscaping providers are independent businesses. Providers control their own estimates, scheduling, work methods, pricing, and service delivery. KouyateIQ does not guarantee pricing, availability, work quality, or project completion.
18. Customer Responsibility to Verify Providers
You are responsible for verifying the suitability, licensing, insurance, and references of any provider before hiring. KouyateIQ performs administrator screening but does not endorse any provider.
19. No Guarantee of Availability or Results
KouyateIQ does not guarantee that a provider will be available in your area, that a provider will accept your request, or that any work will be performed. The live beta allows one provider per request.
20. Provider Obligations
Providers must maintain appropriate licensing and insurance as required by their jurisdiction, perform work in a professional manner, and must not misuse customer information shared with them. Providers may not share, sell, or use customer information for any purpose other than responding to the specific request.
21. KouyateIQ Lead Connect
KouyateIQ Lead Connect is a matching platform that connects customers and organizations with independent service providers across supported industries. KouyateIQ is not the service provider and does not perform the customer's work. The landscaping service is one category within Lead Connect.
22. Lead Connect Subscription Terms
Provider subscriptions are billed monthly during the beta. Subscription fees provide access to Lead Connect and do not guarantee a specific number of leads. A provider must have an Active subscription to receive new paid leads. A Past Due provider may retain access to already purchased leads but cannot receive or purchase new leads. A provider who cancels retains access until the paid billing period ends and does not lose already purchased customer records.
23. Lead Fees and Accept-and-Pay
Individual leads are charged separately through Accept-and-Pay checkout. The backend calculates the final price using the fixed base price and the provider's plan discount; frontend prices are not authoritative. Lead fees purchase access to a verified customer request and do not guarantee appointments, sales, contracts, or revenue. Refund requests are subject to the Lead Refund Policy.
24. Governing Law
Governing law and jurisdiction are to be determined and require legal review.
